So my mom was playing this online poker game that she downloaded to her computer. She was playing and won a huge sum of money. ($20,000). She lives in the state of New York and the money came from Canada where the gambling company is located. Is this legal? Please help! I cannot get her to contact a lawyer. I am an adult by the way, not a little kid asking this.

Anytime someone wins that much money I would definitely get a lawyer. Online gambling is very risky. I hope she actually did win and if she did congratulations.

I think you definitely need a lawyer, if she doesn’t want to contact one then get one yourself. The legal issues here are tricky, as separation of power means the laws may be different between New York, the U.S. as a whole, and Canada. You may check the privacy policy and legalities in the game, as if anything illegal happens you definitely need to contact a lawyer, and possibly sue the company accordingly.
Poker on-line is fine. Ask for a cash out. Assuming it is not a scam, they will just mail you a check. If they ask you for money to send you your Mom her pay out then it may be a scam. You don’t need to send anything to cash out. I have played on-line poker and have won and cashed out. It should be an easy transaction. Deposit the Check into the bank, wait for it to clear and enjoy the win fall. Be sure to claim it as additional income though when you file income tax. While there has been no law put in place to make poker illegal, not paying taxes is and I would bet that 20k is a large enough sum to raise red flags with the irs. An accountant might be a worth while investment for the next tax season though. I can’t see why you would need a lawyer. They will cost you a couple grand just to speak to and I don’t see what they are going to do for you or your Mom in a situation like this other than take and waste your money. Good Luck!!
If your Mom got a check and it cleared. What the heck. Leave it at that. Oh I get it.. Your one of those who will keep fixing it until it’s broke.
Yes. The tender is legal. If she was on a legitimate site that accepted her deposit which has placed the money into her on-line account. It’s definitely legal. Tell her to deposit the money into the account she initially made the deposit from. Leave it there for 21 days. If there any type of scam three weeks is enough time for her to receive any discrepancies.
Sorry but it is illegal. Online gambling is illegal in the US (note the location of the gambling company, and all others). Contact a lawyer because I am not sure what to really do, but technically that is illegal.

Online poker is NOT illegal! Anyone who tells you it is does NOT know the law.
There are laws that make it difficult to deposit money onto online poker sites, and laws that make it illegal to run a poker site from inside the USA. That is is.
I make a lot of money playing poker online, and have never had a problem cashing out. Your mom most certainly does NOT need a lawyer, but she made need an accountant.
